The services that HugeDomains LLC and its parents, subsidiaries, representatives, affiliates, officers and directors (collectively, hereinafter HugeDomains, we, our, and "us") provides to you are subject to the terms and conditions set forth herein ("Terms of Use"), which govern your access to and/or use of the website (HugeDomains.com), use of our content, applications and/or purchase of our products and related services any sites HugeDomains may have now and/or in the future (collectively, the "Services").

By placing an order, purchasing a product or service and/or by accessing and/or using the Services, you acknowledge and agree you have read, understand, and agree to be bound by all of the terms and conditions of this Terms of Use and are entering into a legally binding agreement with HugeDomains. If you agree to this Terms of Use on behalf of an entity, or in connection with providing and/or receiving services on behalf of an entity, you represent and warrant that you have authority to bind such entity or agency to this Terms of Use. In such event, "you" and "your" as used herein will refer and apply to each entity or agency. The terms and conditions of this Terms of Use will govern your access to and/or use of the Services. Please read this Terms of Use carefully. If you do not accept this Terms of Use, now or in the future, please stop your use of the Services immediately.

PRIVACY NOTICE

You expressly agree to HugeDomains privacy notice, located at https://www.hugedomains.com/privacy_policy.cfm ("Privacy Notice") and consent to any personal information we may obtain about you being collected, stored, and/or otherwise processed in accordance with the Privacy Notice and this Terms of Use. We may disclose information in response to subpoenas, warrants, or court orders or in connection with any legal process or to comply with relevant laws.

ARBITRATION NOTICE:

Except for certain types of disputes described in the Arbitration Clause below, you agree that disputes between you and HugeDomains will be resolved by mandatory binding arbitration and you waive any right to participate in a class-action lawsuit and/or class-wide arbitration.

CHANGES TO TERMS

Subject to the conditions set forth herein, HugeDomains may, at any time, for any reason, in its sole discretion make changes to the Services and/or modify this Terms of Use. If HugeDomains makes changes and/or modifications that affect your access to and/or use of the Services, HugeDomains will provide a notice of such changes only by posting the updated Terms of Use on the page and changing the "last updated" date listed at the bottom.

SCOPE OF USE

Eligibility.

To access and/or otherwise make purchases through the Services, you must be eighteen (18) years or older and have the requisite power and authority to enter into this Terms of Use and meet any other applicable age and residency requirements. The Services are not intended for and should not be used by anyone under the age of eighteen (18) and you represent and warrant that you are over the age of eighteen (18) and are the intended recipient of the Services. You may not access and/or use the Services for any purpose if either of the representations in the preceding sentence are not true.

Your Conduct and Responsibilities.

You acknowledge and agree to the following with respect to our Services:

a. You shall not modify, disassemble, create derivative works, publicly display, reverse engineer and/or otherwise reduce to human-perceivable form all or any part of the Services;

b. You agree not to submit and/or transmit any materials through the Services that contain a virus, worm, Trojan horse and/or any other harmful component designed to interrupt, destroy and/or limit the functionality of any computer software and/or hardware and/or telecommunications equipment, and/or that is designed to obtain unauthorized access to any information;

c. You shall not obtain or attempt to obtain access to any of our and/or our third-party provider's systems through any means except as intended to be provided through the Services;

d. You shall not obtain or attempt to obtain any data through any means from the Services, except if we intend to provide and/or make it available to you;

e. You shall not pretend to be someone else, use someone else's identity or misrepresent your affiliation with a person or entity;

f. You shall not copy or imitate part or all of the design, layout, and/or look-and-feel of the Services and/or individual sections of it, in any form or media;

g. You shall not merge the Services or any portion thereof with any other program and/or materials;

h. You are responsible for the accuracy of the information that you submit to HugeDomains and/or our third-party providers;

i. You will not use any robot, spider, crawler, scraper or other automated means or interface to access the Services or to extract or export data collected through the Services;

j. You will use all Services and purchases for lawful purposes only and agree to act in accordance with all applicable laws, rules and regulations;

k. You will not use our Service in a manner (solely determined by us) that promotes, encourages or engages in child pornography, cruelty to humans or animals or otherwise encourages terrorism or violence; and/or engage in or instigate actions that cause harm to HugeDomains or other customers, including without limitation actions resulting in blacklisting any of our Ips by any online spam database, DDOS attacks on servers, etc.;

l. You shall not use the Services for any unlawful purpose and/or to violate any federal, state, international law, code of conduct and/or other guidelines which may be applicable to the Services provided.

In the event HugeDomains has reason to believe you are in breach of this Section, then HugeDomains may suspend your access to and/or use of the Services immediately, without liability.

ERRORS, INACCURACIES, OMISSIONS AND PERFORMANCE

Occasionally there may be information on the Services that contain typographical errors, inaccuracies, and/or omissions that may relate to Services. We reserve the right to: (i) correct any errors, inaccuracies, and/or omission; and/or (ii) make changes to descriptions, prices and/or other information without obligation to issue any notice of such changes, except as prohibited by law.

SALE OF DOMAIN NAMES

Purchase.

All domain names listed on HugeDomains.com are listed by each domain's respective owner, and/or principals, and may be assumed "for sale." In order to complete a purchase of a domain name through the Services you must submit the requisite payment amount as listed on the Services through any of HugeDomains' authorized payment providers. All fees are stated in United States Dollars and must be paid in United States Dollars. All fees due and payable under this Terms of Use are exclusive of taxes, which will be added at the prevailing rate from time to time.

Verification of Sales.

All sales are subject to the final approval of HugeDomains, and we reserve the right to deny fulfillment of any order at any time and for any reason. In the event that HugeDomains decides to stop fulfillment of an order and payment has already been rendered by the buyer, we will issue a complete refund immediately. A domain name sale transaction is not complete until the order has been verified and approved by HugeDomains. All domain name sales are subject to a final review and verification to ensure that the domain(s) subject to the sale are: a) actually available for purchase; and b) there is nothing that would restrict the sale of each domain. Only once the domain name has been transferred into the buyer's name and the buyer has received possession of the domain will a sale be considered final.

Payment Methods

HugeDomains accepts the following payment methods: credit card, debit card, wire transfer, PayPal, and Escrow.com. HugeDomains does not accept payment via check under any circumstances. Any checks sent to HugeDomains will be destroyed without being processed, deposited or cashed.

3rd Party Legal Rights.

HugeDomains is not responsible in determining whether the domain name(s) listed for sale infringe upon the legal rights of others. It is the buyer's sole responsibility to research whether the purchase and use of a domain will infringe upon the legal rights of other entities and individuals, including but not limited to trademark and/or copyright infringement.

Return Policy.

Unless this Terms of Use specifically provides for a refund, all fees for domain purchases are non-refundable. Notwithstanding the foregoing and subject to certain conditions, HugeDomains offers a full refund for domain name sales in the event a buyer chooses to return a purchased domain within 30-days of purchase.

USE OUTSIDE DEFINED AREA

Please be aware that our Services are subject to United States laws, including laws governing privacy and security of your information. Those who choose to access the Services from other locations do so at their own risk and are responsible for compliance with applicable local laws. This Terms of Use is written in English.

PROPRIETARY RIGHTS AND LICENSES

Ownership.

The Services, any content and/or products on the Services and the infrastructure used to provide the Services are proprietary to HugeDomains. By using the Services and accepting this Terms of Use, HugeDomains grants you a limited, personal, nontransferable, nonexclusive, revocable right to access and/or use the Services pursuant to this Terms of Use.

DISPUTE RESOLUTION

Disputes. We want to address your concerns without needing a formal dispute or arbitration. Before filing a claim against HugeDomains, you agree to try to resolve the dispute informally by contacting us at legal@hugedomains.com. We will try to resolve the dispute by contacting you via email.

Opt-Out. You can opt-out and decline this agreement to arbitrate by contacting HugeDomains within thirty (30) days from the date that you first became subject to this arbitration provision.

MISCELLANEOUS

Force Majeure. HugeDomains shall not be liable for any cessation, interruption, or delay in the performance of its obligations hereunder due to causes beyond its reasonable control.

Assignment. You are strictly prohibited from giving, gifting, bargaining, selling, assigning, subletting, or otherwise disposing of your duties and responsibilities under this Terms of Use without the express prior consent, in writing, from HugeDomains.

Governing Law. This Terms of Use shall be governed in all respects by the laws of the State of Colorado, without reference to its choice of law rules.
